Trekking in remote parts of any country carries inherent risk due to weather, potential injury and even death. All of this is beyond our control. Werner Berger – Meet Me At The Top (referred to as WB – MMATT), and its affiliates do their best to reduce any risks and hazards, still there are chances of accidents happening, and for this you and we must agree as follows:

CANCELLATION AND REFUND POLICY – WB – MMATT strongly urges you to acquire trip cancellation insurance. Due to the heavy cost of government permits and booking fees, WB – MMATT, is forced to adhere to a strict cancellation policy.
If you are unable to travel, and have made all payments, you may replace yourself with an exchange person who has the fitness level required to keep up with the rest of the group for an administrative fee of $25.00.
No refunds can be made if you voluntarily leave a trip for any reason after the trip has begun, including accommodation, transport, sightseeing, meals or services not utilized.
Participant’s whose balances are not received by the due dates risk forfeiture of their place on the trek.

PARTICIPANT AGREEMENT, RELEASE, AND ASSUMPTION OF RISK
In consideration of the services of Werner Berger – Meet Me At The Top, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “WB – MMATTT”), I hereby agree to release, indemnify, and discharge WB – MMATTT, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:
- I acknowledge that my participation in a guided trekking trip entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
The risks include, among other things: the hazards of walking on uneven terrain and slips and falls; being struck by rock-fall, icefall or other objects dislodged or thrown from above; the use of trekking equipment; the forces of nature, including lightning, and weather changes; the risks of falling off the rock, mountain or down an incline; the risks of exposure to insect bites; the risk of altitude and cold including hypothermia, frostbite, acute mountain sickness, cerebral and pulmonary edema; my own physical condition, and the physical exertion associated with this activity.
Furthermore, WB – MMATT employees and their contractors have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant’s fitness or abilities. They might misjudge the weather, or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.
- I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.
- I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless WB – MMATT from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of WB – MMATT’s equipment or facilities, including any such claims which allege negligent acts or omissions by WB – MMATT.
- Should WB – MMATTT or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
- I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
- In the event that I file a lawsuit against WB – MMATT, I agree to do so solely in the Province of Ontario, Canada, and I further agree that the substantive law of that province shall apply in that action without regard to the conflict of law rules of that province. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect. While traveling with WB – MMATT I agree to accept the authority of the trip leader or local operator at all times. I am aware that travel within a group may involve compromise to accommodate the diverse desires and physical abilities of group members. I understand that WB – MMATT reserves the right to decline, accept, or retain any person as a member of the group at any time.
- I acknowledge that WB – MMATT contracts with a network of companies, government agencies and individuals, to assist in the running of this treks. To the best of WB – MMATT knowledge, these third parties are qualified to perform the duties they are contracted to perform. However WB – MMATT will not be held liable for any injury, damage, loss, delay or irregularity that may occur due to the behavior of these third parties.
